Palm Beach County Advances One-Year Moratorium on Large AI Data Centers

Palm Beach County commissioners voted unanimously on August 27 to advance a one year moratorium on large artificial intelligence data centers, pausing new applications while county staff write permanent land use rules for an industry that has expanded faster than local zoning codes can follow. A second and final vote is scheduled for September 24.
The ordinance would temporarily bar the county from accepting, processing, or approving new applications for facilities that meet its definition of a large scale data center. Under that definition, any facility expected to draw 50 megawatts or more of electricity at peak demand qualifies, and the county will assess power usage across an entire property rather than parcel by parcel, a change designed to prevent developers from subdividing a campus to stay under the threshold.
For Palm Beach County residents, the vote is the clearest signal yet that South Florida's fastest growing category of industrial development will face local limits. For the rest of Florida, it is a template. Palm Beach is the latest in a series of Florida counties to move toward a pause, and county governments statewide are watching how the ordinance is drafted.
What the county approved
The action taken on August 27 was a preliminary approval that advances the ordinance to a final public hearing. Commissioners voted 7 to 0. The moratorium, if adopted next month, would run for one year and would apply to new applications rather than projects already approved.
The 50 megawatt threshold is the operative number. To put that figure in perspective, a facility drawing 50 megawatts at peak uses roughly as much electricity as tens of thousands of Florida homes. Hyperscale campuses proposed in other states have sought several times that amount, which is why the county chose to evaluate demand across a full site rather than treating individual buildings separately.
County staff have been directed to use the pause to rewrite zoning provisions covering where data centers may locate, how far they must sit from homes and schools, what landscape buffers and separations are required, what noise studies applicants must submit, and how utility coordination is handled before approval. Commissioners also urged staff to consider stricter limits than the initial draft contained.
Nothing in the ordinance bans data centers permanently. The county's stated purpose is to buy time to write standards, not to close the door on the industry.
Why counties are pausing
Data center development in Florida has accelerated alongside national demand for artificial intelligence computing capacity. These facilities are electricity intensive and, in many designs, water intensive, because cooling large racks of processors requires either substantial water throughput or substantial additional power for closed loop cooling.
That combination produces a specific set of local concerns. The first is electrical load. A single hyperscale campus can require transmission upgrades and generation capacity that affect the broader grid, and utilities recover those costs through rates paid by all customers unless the developer covers them directly. The second is noise, since cooling equipment runs continuously. The third is water, which matters acutely in a state where supply planning is already constrained.
Land use is the fourth concern and the one most squarely within county authority. Data centers occupy large sites, generate relatively few permanent jobs compared to their footprint, and often seek locations near existing transmission infrastructure, which in Palm Beach County can mean parcels close to residential neighborhoods.
Counties elsewhere in Florida have taken similar steps in recent months, and the pattern is consistent: a temporary pause paired with a directive to staff to produce standards. The moratorium is the tool available when applications arrive faster than rules can be written.
The Florida context
Florida's electricity demand has been rising for years on the strength of population growth alone. That geography makes environmental review politically salient in a way it might not be in a less constrained market.
Palm Beach County's decision to measure power demand at the site level rather than the parcel level is a technical detail with real consequences, and it is the kind of provision other counties are likely to copy.
What supporters and opponents say
Supporters of data center development point to capital investment, property tax base, and the argument that computing infrastructure will be built somewhere and that Florida benefits from hosting it. Construction phases employ substantial numbers of workers, and the facilities themselves generate significant taxable value relative to their service demands on schools and public safety.
Residents who pushed for the pause have focused on cumulative effects rather than any single project. Their argument, as presented at county meetings, is that approving facilities one at a time under rules written for conventional light industrial use produces outcomes no one evaluated in advance, particularly on electricity and water.
Commissioners who urged stricter limits during the August discussion signaled that the final ordinance may tighten the initial draft. That could mean a lower megawatt threshold, larger required separations from residential areas, or more demanding noise and utility studies.

The practical effect of a moratorium is to shift the timeline. Developers with active interest in Palm Beach County will either wait out the pause, redesign to fall below the threshold, or look at neighboring jurisdictions. For Florida Power and Light customers, the relevant question is how large new loads are financed. Utilities can require large customers to fund interconnection and capacity costs, and the structure of those agreements determines whether residential ratepayers see any effect. Those arrangements are reviewed at the state level, not by counties.
Municipalities within Palm Beach County retain their own zoning authority, so the county ordinance applies to unincorporated areas. Cities that want a similar pause would need to act separately, and some may.
Water, power, and the numbers behind the debate
The two resources data centers consume at scale are electricity and, in many cooling designs, water. Understanding roughly how much helps explain why a 50 megawatt threshold was chosen rather than a larger or smaller figure.
A facility drawing 50 megawatts continuously consumes on the order of 438,000 megawatt hours per year. Florida residential customers use roughly 14,000 kilowatt hours annually on average, which places a single 50 megawatt facility in the range of tens of thousands of homes. Hyperscale campuses proposed elsewhere have sought several hundred megawatts, which would scale that comparison accordingly.
Cooling is the second demand. Evaporative cooling designs consume water directly, with consumption varying substantially by climate and by design. Florida's heat and humidity affect that calculation in both directions: high ambient temperatures increase cooling load, while high humidity reduces the efficiency of evaporative approaches, which pushes some designs toward closed loop systems that use more electricity and less water.
The tradeoff between water and power is therefore a design choice, and it is one that county land use rules can influence by requiring applicants to document projected consumption of both before approval.
What other Florida jurisdictions have done
Palm Beach County is not acting in isolation. Several Florida counties have moved toward moratoriums or toward tightened standards over the past year, and the pattern has been consistent enough that the ordinances increasingly resemble one another.
The common elements are a defined power threshold, a temporary pause on new applications, and a directive to staff to produce permanent standards addressing siting, separation from residential and school uses, noise limits measured at the property line, and coordination with the serving utility.
