Florida Orders License Plate Readers Off State Highways Within 30 Days

The Florida Department of Transportation has revoked existing approvals for automated license plate recognition systems installed along roads in the State Highway System, ordering local agencies to remove the equipment within 30 days. The memorandum followed public criticism of the technology from Governor Ron DeSantis, who said he does not want Florida to become a surveillance state.
The department cited an exponential increase in deployments along with concerns about misuse, data privacy and surveillance as justification for immediate action. FDOT said it will remove any cameras remaining after the deadline and will stop approving future requests to install license plate readers within state highway rights of way.

The policy questions a statute would need to resolve include retention periods for collected data, who may access it and under what authorization, audit requirements, whether data may be shared with agencies in other states or with federal authorities, and what remedies exist when rules are violated. Other states have addressed those questions with varying approaches.

A network that discards reads after a short interval provides real-time alerting while limiting the historical record available for retrospective queries. Extended retention enables investigation of older cases but creates the comprehensive movement history that privacy advocates identify as the core concern.

Camera networks operated by different agencies are frequently interconnected through vendor platforms, meaning a read captured by one agency may be queryable by others across jurisdictional and state lines. The business model behind the cameras
Much of the rapid growth in deployments traces to a procurement model that differs from how agencies historically acquired equipment. Rather than purchasing cameras outright and building the supporting infrastructure, departments subscribe to a service in which the vendor supplies, installs and maintains the hardware and operates the software platform for an annual fee per camera.
That structure lowers the barrier to adoption substantially. A small municipal department that could never fund a capital project for a surveillance network can add several cameras within an operating budget, and the recurring cost is modest enough that it frequently does not trigger the level of governing body scrutiny a capital purchase would receive.
