Florida Prepares AI Rules for Its Colleges and Universities With a Vote Set for September 16

Florida is moving to write artificial intelligence rules into the governing documents of its public higher education system. The Florida Department of Education has proposed a rule requiring all 28 institutions in the Florida College System to adopt policies governing how students, faculty, staff and campus visitors may use artificial intelligence. The State Board of Education is scheduled to take up the proposal on September 16 at Polk State College in Winter Haven.
A parallel effort is underway on the university side. The State University System is developing its own requirements for Florida's 12 public universities, and the Board of Governors is expected to consider language directing universities to require course syllabi to disclose both faculty use of artificial intelligence and the specific student uses a given course permits. That syllabus disclosure provision is the piece most likely to be felt directly by students in a classroom.
The two tracks trace back to the same origin. At a Board of Governors meeting in March, the State University System created an artificial intelligence and cybersecurity task force, and that body has since been working through what campus-level governance should look like. Its recent discussion included an amendment asking university boards of trustees to establish stricter usage guidelines rather than leaving the question to individual departments.
What the college system rule would require
The Department of Education proposal does not attempt to write a single statewide AI policy and impose it on every campus. It instead requires each of the 28 colleges to have a policy, and sets out the categories that policy must address. That structure gives institutions room to differentiate between a nursing program, a welding program and a general education writing sequence, which have genuinely different exposure to the technology.
The categories the rule reaches are broad. Policies would need to cover student academic use, faculty instructional use, staff administrative use and access by campus guests. Including staff and visitors is a notable expansion beyond academic integrity, because it pulls in questions about what institutional data may be entered into third-party AI tools and who is accountable when it is.
That data dimension is where community colleges have the least existing infrastructure. Entering a student record, a financial aid document or a disciplinary file into a consumer chatbot raises federal student privacy questions under FERPA, and most institutions have not previously had to answer whether an employee doing so constitutes an unauthorized disclosure.
The proposal arrives after roughly two years in which Florida campuses handled artificial intelligence through a patchwork of syllabus statements, honor code interpretations and informal departmental guidance. The inconsistency has been the practical complaint from students, who have reported facing very different rules in courses taken in the same semester at the same institution.
The syllabus disclosure question
The university-side proposal under discussion at the Board of Governors would put artificial intelligence disclosure directly into the syllabus, the document that functions as the contract between an instructor and a class. Requiring faculty to disclose their own AI use is the more unusual half of that provision, since most institutional policies nationally have focused on students.
Faculty use spans a wide range, from generating a quiz bank or a lecture outline to drafting feedback on student work. Instructors and student advocates tend to draw the line at the last category. Automated feedback on graded work touches the core of what students are paying for, and disclosure requirements are one way institutions have tried to keep that boundary visible without banning tools outright.
On the student side, syllabus disclosure would force instructors to be specific in a way many have avoided. A blanket prohibition is easy to write and difficult to enforce. Stating which uses are permitted, brainstorming but not drafting, grammar correction but not content generation, research discovery but not citation, requires an instructor to decide what the assignment is actually assessing.
Faculty governance bodies have generally supported disclosure requirements while resisting centrally dictated substance. The University of North Florida's AI council, for instance, favored flexibility over a single campuswide policy, a position that reflects the disciplinary variation across a university more than opposition to governance.
Detection, enforcement and the honor code problem
Any policy framework eventually collides with the enforcement question, and here Florida's institutions face the same difficulty as everyone else. AI detection software has a documented false positive problem, and the errors are not randomly distributed. Multiple studies have found that text written by non-native English speakers is flagged at elevated rates, which creates a discrimination exposure for institutions that rely on detector output as evidence.
Academic integrity offices have generally responded by treating detector scores as a reason to look further rather than as proof. That approach shifts the burden onto process: document version histories, in-class writing samples, oral defense of submitted work. It is more defensible and considerably more labor intensive.
Assessment redesign is the other response, and it is the one that changes teaching rather than policing. Instructors have moved toward in-class writing, oral examinations, work that requires engagement with material available only in the course, and assignments that ask students to critique AI output rather than avoid it. Those changes take faculty time that community colleges with heavy teaching loads have in short supply.
The proposed rules do not resolve the enforcement question, and they are not designed to. What they do is require each institution to have written down its answer, which at minimum gives a student facing an integrity charge a document to point to.
Why Florida is moving now
Florida has positioned artificial intelligence as an economic development priority, and the state's public institutions have been building capacity accordingly. The University of Florida has invested heavily in campuswide AI infrastructure and curriculum, Florida State has developed its own AI initiative, and the University of South Florida established a dedicated college focused on artificial intelligence and computing.
That investment posture makes a governance framework more urgent rather than less. Institutions marketing AI fluency as a credential need a coherent answer to what students are permitted to do with the technology in the courses that produce that credential, and inconsistency undermines the value of the degree.
There is also a workforce argument that runs through the community college side specifically. The Florida College System's mandate is heavily oriented toward job placement, and employers in fields from health care administration to logistics now expect familiarity with AI tools. A blanket campus prohibition would put graduates at a disadvantage the system exists to prevent.
The state is simultaneously moving on artificial intelligence in K-12, which means Florida students may encounter formal AI rules from middle school through a graduate degree within a few years. Alignment between those levels has not been established, and it is one of the harder problems the department has ahead of it.
What campuses are already doing
Several Florida institutions are ahead of the rulemaking. The University of Florida publishes guidance and instructional resources for faculty, and Florida State maintains a faculty resource set through its AI initiative. Those materials tend to offer sample syllabus language and decision frameworks rather than prohibitions.
Community colleges have generally moved more slowly, which is a resource question rather than a philosophical one. Drafting institutional policy, training faculty and adjusting assessment practices requires staff capacity that a college serving a large part-time student body with a lean administration does not always have available.
The rule's implementation timeline will therefore matter as much as its content. A requirement that colleges adopt policies without a realistic runway tends to produce documents copied between institutions, which reproduces the inconsistency the rule is meant to address.
The accreditation and transfer dimension
Florida's college and university systems are bound together by one of the most consequential transfer arrangements in American higher education. An associate degree from a Florida College System institution guarantees admission to a state university, and course equivalencies are managed through a statewide common course numbering system. That architecture means a policy divergence between the two systems creates friction for the students who move between them.
A student who completes a composition sequence at a state college under one set of AI rules and then enters a university writing-intensive course under a stricter set has been trained into habits that could become an integrity violation. The systems have not publicly addressed how they intend to align, and the two rulemaking tracks are proceeding on separate calendars.
Regional accreditation adds another layer. Accrediting bodies evaluate whether institutions can demonstrate that students achieve stated learning outcomes, and generative AI complicates the evidence institutions have historically used to make that case. Written work submitted outside a proctored environment carries less evidentiary weight than it did three years ago.
Institutions that adopt clear, documented policies are better positioned in an accreditation review than institutions relying on informal practice, which is one of the quieter reasons system-level requirements are attractive to administrators. The rule gives every campus a document to produce when asked.
What students and faculty should watch
For students, the immediate practical question is whether the courses they are enrolled in this term change their rules mid-semester. Institutions generally avoid that, and syllabus policies set at the start of a term typically govern it, but a student uncertain about a specific assignment should ask the instructor directly rather than infer from a campus announcement.
For faculty, the meaningful deadline is not September 16 but whatever adoption schedule follows. A rule requiring institutional policies sets off a local process at each campus, generally running through faculty senate and academic affairs, and that is where the substance gets decided.
For institutions, the open exposure is on the data side rather than the academic integrity side. A student privacy incident arising from staff use of a consumer AI tool would be a federal compliance matter, and it is the scenario least addressed by existing campus practice.

The State Board of Education meets September 16 at Polk State College in Winter Haven to consider the Florida College System rule. The Board of Governors is on a separate track for the 12 public universities, and its consideration of syllabus disclosure language will follow its own meeting calendar.
Should both bodies act, Florida would join a small group of states that have moved artificial intelligence governance from campus practice into system-level requirement. The details that will determine whether the framework works, the enforcement standards, the data handling rules and the resources attached, largely remain to be written at the campus level.
